World of Warcraft? — Beta Contest Terms & Conditions
NVIDIA AND WORLD OF WARCRAFT BETA CONTEST TERMS & CONDITIONS
Hosted by NVIDIA Corporation ("NVIDIA").
NO ENTRY FEE. NO PURCHASE OR OBLIGATION NECESSARY.
1. Eligibility: The NVIDIA AND WORLD OF WARCRAFT BETA CONTEST (the "Contest") is open only to legal residents of the U.S. and Canada, age 18 or older, who have an active e-mail account and Internet access as of the beginning of the Contest period.
Employees of NVIDIA, Blizzard Entertainment or Vivendi Universal Games, their respective affiliates, subsidiaries, immediate family members and persons living in their same household, are not eligible to participate in the Contest. Participation in the Contest constitutes entrant's full and unconditional agreement to and acceptance of these Terms & Conditions ("Terms").
2. To participate in the Contest, entrants must log on to
www.nvidia.com/nzone, fill out the required fields in their entirety, and click on the button to submit the form no later than midnight (12:00 a.m.) PST on September, 20 2004. One entry per person, household and/or e-mail address is permitted, regardless of method of entry. Entrants submitting multiple entries or violating any of these Terms may be disqualified.
3. Beta Contest Selection: After the deadline for submitting entries, NVIDIA will randomly select 1,000 Program entrants meeting the Contest requirements to receive a user account for the WORLD OF WARCRAFT BETA PROGRAM. The selected entrants will be offered the opportunity to participate in the Beta Program according to the terms and conditions of that Program, which is designed and administered entirely by Blizzard Entertainment. In order to participate in the World of Warcraft Closed Beta, the Selected Entrants must agree to the World of Warcraft Beta Test Agreement and World of Warcraft Beta Terms of Use. NVIDIA has no involvement in the Beta Program itself.
4. Notification of Participants: Participants will be notified of their entry into the Program by receipt of an e-mail from Blizzard Entertainment. Entries will be deemed to have been submitted by the authorized account holder of the e-mail account specified in the entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No automatically generated entries will be accepted.
5. Privacy Policy: Any personal information supplied by you in connection with the Program will be subject to NVIDIA?s privacy policy posted at
www.nvidia.com/view.asp?IO=privacy_policy. By entering the Contest you are automatically registered as a visitor of NVIDIA?s website and certain personally identifiable information is collected by NVIDIA. Among other things, NVIDIA?s privacy policy provides that you may receive additional e-mail communication from NVIDIA.
6. General Rules: By entering, you agree to be bound by these Terms. The Contest is offered and hosted by NVIDIA Corporation, which is not responsible for late, lost, delayed, damaged, incomplete, illegible, or misdirected entries, responses, or other correspondence, or for theft or destruction or unauthorized access or alterations of entry materials, phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties. By participating, entrants agree to release NVIDIA and its respective parents, affiliates, subsidiaries, directors, officers, employees, and agents, including advertising and promotion agencies, from any and all liability with respect to the Contest or the acceptance, possession or use of any Beta software, including without limitation (i) any condition caused by events beyond the Host's control that may cause the Contest to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of participation in the Contest; and (iii) any printing or typographical errors in any materials associated with the Contest. NVIDIA's decisions in all respects relative to the Contest are final. NVIDIA reserves the right, in its sole discretion, to cancel, modify or suspend the Program in whole or in part, for any reason, but in particular in the event of fraud, technical or other difficulties or if the integrity of the Contest is compromised, without liability to the entrant. NVIDIA reserves the right to disqualify any entrant, as determined by NVIDIA in its sole discretion. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. All federal, state, provincial and local regulations apply.
