Dear Sir:
Our firm represents Compex Corporation, Inc. (hereinafter, "Compex"). We were notified by our client that your organization operates under the name Mobile Universe on the World Wide Web, and is using the domain name "Mobile-Universe.Net."
Please be advised that Compex is the sole owner to the entire right and title for U.S. Trademark Registration No. 2,491,193 for "MOBILE UNIVERSE" in connection with computer services, namely, communications software design for others; installation of computer software, and updating of computer software; and technical consultation and research in the field of mobile computing and wireless communications for the benefit of various government agencies and private industry organizations. Compex has used and continues to use the mark MOBILE UNIVERSE throughout the industry, and especially on the World Wide Web.
Compex has made a significant investment in developing the use of their mark and is very concerned over any use of their mark by a third party that would result in confusion and thereby detract from the goodwill and reputation that they have built to date.
We believe that your organization's use of Mobile Universe as a company name and in a domain name causes confusion or mistake, or deception in those familiar with our client's mark, and thereby infringes our client's rights in the mark.
Because of our client's federally registered trademark and their extensive use of the mark in the industry, our client has certain rights of exclusivity in the U.S. which are protected under law, such as through the Anticybersquatting Consumer Protection Act and the Lanham Act, against those having a presence in the U.S. or conducting business in the U.S. In addition, ICANN and all domain name registrars throughout the world recognize those rights through the Uniform Domain Name Dispute Resolution Policy. By your having registered a domain name, you are subject to the rules, regulations and adjudication under that policy.
Therefore, we demand that your organization cease and desist from all activities that infringe upon the trademark rights of our client and upon the goodwill and reputation that our client has built up in the industry, including ceasing all use of the name Mobile Universe and the domain name Mobile-Universe.Net. Further, we demand that your organization provide us the necessary information and assurances to show that you have taken the necessary actions to prevent any further infringing use of our client's mark on or before July 31, 2002. We hope that you will cooperate in expeditiously resolving this matter.
Our client would of course prefer to resolve this matter in an amicable and business-like manner. However, if necessary, our client is prepared to protect its trademark rights and interests through the different avenues available to them. Therefore, we would suggest that you contact us on or before the above date so that this matter can be resolved expeditiously. Otherwise, if we do not hear from you, we will have to confer with Compex and reconsider the other avenues available to them.
