Problems with phpNuke Security* has forced us to take the site offline temporarily, until we can find a replacement for the portal.

It all started 2 years ago, when an anonymous ticket post in Sourceforge claimed that BeOS Max was illegal and violated the PE distribution and therefore Palm intellectual property.
At that time, the creator of the Crux project page that hosted BeOS Max replied with this:

"As far as the legality of all this is concerned we are
in no way illegally distributing this and yes we are
actively replacing parts of the original BeOS software
with Open Source software like Open Tracker, OpenBeOS
dev tools , Print Server Beta(in v2.2) etc.

We are no way modifying the original source or the
licenses for the BeOS PE , but only adding more
drivers software etc. to the PE.

BeOS PE is also freely downloadable.

We are only adding freely available and legally
allowed code to BeOS.

We had lots of similar debate on BeBits and elsewhere
but we have been very clear that we are in no way
going against the BeOS License.

Hope you understand and allow us to carry on so that we
can package a distro of Open Source BeOS as and when it
becomes available.

The effort right now is to keep the spirit and
enthusiasm related to BeOS alive, without any
financial motivation whatsoever.

There is also a similar effort at BeOSonline.com and
which was the only source till we improved upon it.

This response seemed to appease the Sourceforge administrators and the matter ended there... or did it?

NOPE. Because that nice ANONYMOUS poster, again did his thing. He reopened the ticket adding part of a copy of PE license, which CLEARLY states that anyone who wants to change or redistribute PE needs the permission of Be. HOWEVER since Be has closed, we cannot get any such permission... well perhaps JLG can give us one, but he is not Be. Be is closed.

After this, and because Sourceforge is afraid of legal problems with Palm (not a chance since the PE is not their intellectual property, only the code is) they deleted the project.

The Anonymous poster claimed that BeOS Max did more harm to the Open Source community than it helped!!! How? By keeping the interest on BeOS and its Open Source derivatives which we advertised every chance we got? Or perhaps by supporting the open source community by giving money, and web space? How does the Anonymous poster claims we hurt the open source community?

However, I have to say one thing to keep some rumors down. Some in the Open Source community are quick to put behind this the creators of Zeta, YellowTab. They are NOT behind this. I have talked to Berndt repeatedly and when I asked him if he would like me to stop the distribution of Max now, he said he thought it was good that Max was around. The same applied for all BeOS distroes.

I have one more thing to say. I ask the person who posted the ticket Anonymously on Sourceforge, to contact me and tell me WHERE can I find Be and ask for their permission. Also I would really like to have his name since I never hid mine.

Now as to as how long it will take for BeOS Max to be back on line and downloadable that depends on how fast I find a host for the files. I have asked Sourceforge to reconsider, but I am not holding my breath.

Waarom nu dit weer? BeOS Max is echt de enigste BeOS distro die goed werkt op mijn systeem. Iemand meer informatie?

Volgens mij is hij gewoon legaal, omdat hij alleen aanvullingen heeft op de PE versie

Helaas, is het mij nog steeds niet gelukt om het aan de praat te krijgen op mn pc :( t werkte alleen op mn klaptop (in save modus) :(

Want t werkt verder zo fantastisch!

Heb je liever vooraf, of achteraf, dat ik zeg dat ik geen flauw idee heb wat ik doe?

BeOS max is legaal.

Ik vermoed eigenlijk dat mr anonymous een fervente linux gebruiker is. Als trouwe beos/zeta gebruiker heb ik aan den lijve ondervonden dat onze opensource vrienden van linux soms vreselijk verbaal agressief kunnen zijn als het gaat om een niet linux open source project. BeOS wordt door sommigen van hen als een "dood os" beschouwd en alle tijd die erin gaat zou zonde zijn. Onzin natuurlijk maarja.... Ik heb welleens op een ander forum geopperd dat de rivaliteit onstaan is uit angst voor beos, de interface is immers stukken vriendelijker en sneller dan linux, maar daar kreeg ik toen weinig reactie op.
