Sorry Guys - this one's too complicated for my limited Dutch too.

David McOwen was jailed, and held prisoner for over 6 hours, handcuffed to another prisoner and shuttled back and forth between jail cells.

This, after having been instructed to process, and release him. :(

He called me a little while ago. He's out on bail now. He was treated like the worst scum on the planet. Thought you guys would want to know.

I'm sorry if there was an implication that he had been convicted.

He is charged with 8 felony counts of computer tresspass and computer theft. Each carries a stiff penalty in jail time and money.

He has not gone to trial yet. This was just where they take his fingerprints and his promise to come back to court for trial.

This battle is not over by a long shot!

Thanks to the DPC, David has been able to pay substantial amounts of his lawyer bills! :) Dank U wel! :)

It's terrible. :(

They set an example of him so that others would think twice about installing the client...but the strange thing is that distributed computing is just starting. A few days ago there was news that Hewlett-Packard is starting to begin distributed computing and wanted to get the attention of other companies.

Is there a change David can go to the supreme court of something?

There are alot of things that can happen right now.

The state can:

drop the charges
negotiate a plea for a charge and have others dropped
go to trial

The state would evidently like to go to trial. This will result in the expendture of huge amounts of money so that they can look like fools. It's going to be political suicide in the long run for the Governor and the Attorney General. We're PISSED OFF!

If he lost at trial, he could appeal to a higher court.

The EFF (Electronic Frontier Foundation) - it's the cyber-equivalent of the ACLU is interested in this case. It's a long way from over.

Thx, now i understand what could happen to him (the law is much different overhere)

I don't hope this case is somewhere related to the new anti-terrorisme bill from minister Ashcroft to compare hackers with terrorists and to charge them the same penalties.

DanC, do you have some more information about the defense of David (why the client doens't do any harm etc.)

Most of the useful information can be found at Dnet itself.

Aside from that, expert testimony from professionals in the IT field who can testify to the client being benign.

There will certainly be some case law to quote once this is done. The georgia monkey-boys really screwed up this one, and now they're so belligerent they'd rather go through with it than admit they were wrong. :?

A lot of things are going through my mind right now, but it wouldn't be wise to post them here or at your board. I just have a lot of questions where probably no one has an answer to. For instance. Why is he being cuffed? Are they afraid that he's going to flee or something?

There is an easy answer to your question.

Humiliation, and degradation. They want to frighten and subdue him to make themselves feel powerful.

There will be ways you can help. We're organizing some new efforts right now. DPC have proven to be our brothers in this... I'll keep you posted so you can join the effort!

This is Donna McOwen's (David's Wife) account of yesterday:

First, I would like again, to thank each and every one of you for the support you have given my husband, David.

Yes, this started as a nightmare and is continuing, especially last night. What a bureaucracy after being at the jail. The situation was set up so David could go in, turn himself in (a time was set up by the Attorney Generals office so this could be done..bond set up prior before we got to the jail) and then booked and then released.

The worst would have been two hours, per what the bondsman said. Well, the nightmare of last night started. It was 5 to 6 hours before we got out of there, with myself and a dear friend who came with us (thank goodness). I dont think I could have survived alone. Every thirty minutes after the two hours, I check to see what and where David was. A different story each timeno kindness, no remorse, no nothing from these employed people at the jail.

To make a long story short, at the fifth hour I went to the front desk and asked to see a superior officer, supervisor..I was determined to get David no matter what.gave me another story it would be a while longer, 10 people before him (after when I check 30 minutes ago and they told me go home..in which I looked them in the eye and said I will not leave here without my husband, plus I live almost two hours away!!!..that person could care less).I said to the person who told me 10 people in front of him Someone else told me at one point, twenty.so what is it 10 or 20?)

Another lady, heard what was happening and said she would call to find out where he was, even looked on the sheet she had and said softly, this was suppose to be an in and out process.well, she finally got someone to release David next. He came out in 15 minutes. She saw I was very distraught, stressed out, etc and had some sympathy for what was going on. I would not wish this on anyoneI can guarantee you, I will be getting more into the political scene when these elections start coming up, if not before. And I will work with you all to help David get over this and we will winas a lot of people have said, this is unfair, unjust and should not be happening.

I am not saying this cause he is my husband, it would be for anyone that would go through this. We will conquer this..we just have to stay level-headed and work with Mr. Joyner and start our defense team pronto! And what a team we will have!!!!!!!

Even in these sort of situations I always try to see the good thing in people. It doesn't make things right, but maybe (I hope so) those people at that office aren't aware of what 'felony' David has committed. When your treat a murderer or something like that, OK, but a person who put a computer program on some PC's? I can hardly believe it. Happily there always are some people who do use their mind (the kind lady Donna was referring to).
Let's just hope there are more of that kind of people on his jury (if it will get that far).

Just one more thing. I'll do this in Dutch:
Iedereen geeft wel eens aan een goed doel en waar dat geld dan heen gaat is vaak onduidelijk. Alle goede doelen zijn goed, maar misschien dat we in dit geval in ons hart moeten kijken en zien dat David's zaak wel heel dicht bij ons (in ieder geval mijn) hart zit. Dus als je denkt dat je in het weekend een biertje minder kan drinken (of koop die 128mb dimm een maand later, kost toch niets meer), maak dan wat geld over naar kifaru (hij regelt voor de rest alles) en je bent een beetje van dat gevoel van onmacht af. It worked for me.

(Maak er geen draadje van of iemand wel of geen geld over moet maken en waarom niet. Het is een klein verzoek van mij. Ben je het er niet mee eens, ignore it).

Toch maar eens een andere sig bedenken :P

Most foreigners don't know the difference between Deutsch and Dutch.

Deutsch, Dutch & English (and some others) are German languages, like French and Spanish are Roman languages.... that's why our languages aren't too difficult too understand (although Dutch and Deutsch are closer related than English and Dutch)

My most sincere apologies for having offended any of you. You all know me well enough by now to know that if I were hurling insults - they'd be ALOT better than that.

I've tried to pick up some of your language out of respect. Since I speak (that other language) it helps to get at least an idea of what you're saying. Of course, being a typical, slothful, lazy American - I don't have the inclination to actually LEARN Dutch. (Joke's on me guys)

Anyway - no offense intended. - but I have a feeling you knew that, and are baiting me.... hehe. Can't blame you a bit for that. All in good fun.

We (I'R Cow) had the idea of collecting money at the DPC-LAN-meeting in Drenthe, but most of the people thought it would not be a good idea and it would make no difference.

LoWLaNDeR: If everybody always thought that nothing would make a difference, nothing would ever happen.
I think it's a great idea. Maybe the money won't set David free, but no money isn't helping either.

Apart from that, I think it is a good thing to point people towards things, where they wouldn't normally think about. Just to remind them how well off we are here in The Netherlands.

Unfortunately I'm not organizing this LAN, but it would mean lot to a lot of people if you'd just make a small note (in Dutch) about what's happening to David and let people decide for themselves if it's usefull to donate money or not.

Veel plezier trouwens wat je ook beslist.

And you haven't offended me by comparing Dutch to Deutsch.
I'm over this WW2 thing, suggest my fellow Dutchman to do the same. It's a bit silly, and not based on anything anymore. Just something that is brought on from grandparents, to parents to kids (us).
