YouTube blijft ondersteuning bieden voor h264, de closedsource-tegenhanger van WebM.

h.264 is niet closed source, alleen moet je dokken vanwege de patenten die erop rusten (afhankelijk van wat je ermee wil doen). Er zijn net zo goed opensource implementaties van en de specs zijn gewoon in te zien.

WebM is bedoeld als licentievrij, opensource-compressieformaat

WebM heeft wèl een licentie, waar instaat dat je Google niet aan mag klagen. Je hoeft echter niet te betalen.

Dat is de licentie voor de patenten. De software zelf valt onder een BSD licentie. Er is dus zeker wel sprake van een licentie, echter wel eentje die heel open is. Maar zeker niet licentievrij.
